Stronger Child Porn Laws for New Jersey

New Jersey lawmakers are attempting to pass legislation that would strengthen the child pornography laws already on the books and make them comparable to the federal laws which are considerably tougher. Currently, there is a vast disconnect between federal child pornography law and state law. An individual charged in federal court, for instance, could receive a jail sentence, while someone charged for the same crime in state court could merely receive probation.

Some of the child pornography law enhancements include:

1. Mandatory minimum prison terms for individuals convicted of distributing at least 25 images, with a first time offender receiving a 5 year minimum prison sentence;

2. Better defining the gray area with regard to sharing images with a computer file sharing program, making it clear this is considered distribution and not just possession, and

3. Mandatory service of 85 percent of a prison sentence pertaining to a child pornography conviction.
