Family Law Matters

Family law matters are often turning points in our clients' lives. You may be ending a marriage but starting a new life as a single - and hopefully happier - individual. You might be entering into a marriage and want to ensure you are protecting your finances through a prenuptial agreement. Your legal matter could be a joyous occasion, such as adoption, or be an issue causing you difficulty, such as obtaining child support payments.

All of these matters, even if they result in improved circumstances, are stressful. That is why you need a knowledgeable and compassionate family law attorney on your side, to ensure that your legal and financial interests are protected during the transition.

At Winegar, Wilhelm, Glynn & Roemersma, we are your allies throughout your family law issue. We treat every client as if we were in the same legal circumstance he or she is facing. We are dedicated to providing every client with focused, ethical, and cost-effective representation.

Divorce/Division Of Marital Assets

Both Pennsylvania and New Jersey are equitable distribution states. What this means for you is that during the divorce it will be decided what a fair division of assets is for you and your soon-to-be ex-spouse. Keep in mind this does not necessarily mean an equal split.

Our divorce lawyers have significant experience in managing all aspects of a divorce case. From mediation to valuation of a business, we can help you protect your financial future through a fair division of marital property.

Alimony is designed to provide adequate income for the spouse who was financially dependent on the other spouse. Winegar, Wilhelm, Glynn & Roemersma, P.C.'s experienced Pennsylvania and New Jersey alimony lawyers can help you obtain the fairest alimony agreement possible. Unlike child support, there is not necessarily an obligation for alimony, even if one spouse makes more annual income than the other.

Grandparent Rights

Grandparents may have a legal right to spend time with their grandchildren. However, this right is not automatically conferred like the relationship between a parent and child. Obtaining visitation time (or custody) is not guaranteed, and chances are that a grandparent's application may be vehemently opposed. Grandparents must prove to the court that their custody of and/or visitation with the grandchild is in the best interest of the child. Laws may vary from state to state. It is important to involve an experienced Family Law Attorney.

Other Family Law Services

  • Prenuptial agreements. Premarital agreements are legal contracts formed between individuals who intend to marry. These agreements typically stipulate how assets and property may be divided in the event of divorce or death and are a practical way to prepare for unforeseeable future occurrences. In some ways, premarital agreements act as a form of insurance, saving time and money in the event of divorce.
  • Domestic violence/restraining orders. Even if no criminal charges are filed, one party may petition the court for a restraining order, also known as a protective order, to prevent the other person from harming, contacting or otherwise disturbing them. With the assistance of a qualified family lawyer, victims of domestic violence can take appropriate steps to document the abuse and protect themselves from further harm.
  • Adoption. Adoptions legally establish a parent-child relationship. The extensive procedures that dictate adoption proceedings can be lengthy and confusing, and can vary depending on whether you live in Pennsylvania or New Jersey. Often, the adoptive parent will require the assistance of an experienced family lawyer to ensure that all legal requirements are met.
