Types of Compensation

The types of compensation that come with a New Jersey workers' compensation claim can vary depending on the circumstance. Benefits may include:

  • Medical benefits: Medical benefits cover any reasonable and necessary medical care ranging from medications to physical therapies to surgeries. In New Jersey, you are required to stay with the doctor provided by your employer and may not treat with your own doctor.
  • Wage loss benefits: These benefits are intended to compensate a percentage of lost wages due to the inability to work over an extended period of time. You are entitled to monetary benefits on a weekly basis while you are out of work, and there is no limit on the time you can receive those benefits. However, these benefits will be limited based on when you will be returning to work.
  • Partial Permanency: Once treatment has ended, you have the right to receive a monetary award for your injury despite being able to return to work. You would be required to attend an exam with a doctor provided by your attorney as well as a doctor provided by your employer or insurance provider. Both doctors will write a report on your injury, and the percentage of impairment correlates to monetary benefits in the form of a lump sum or weekly check.
  • Lump-sum settlement: You may have the option to receive disability benefits over time or take a cash settlement up front. When you receive a lump sum payment, your case is closed permanently, resulting in the cessation of medical rights.
  • Death and dependency claims: If someone dies as the result of a work injury or illness, his or her loved ones may be eligible for compensation. Common dependents that receive benefits include the surviving spouse, biological children, adopted children, parents and grandparents.
