Now that summer is finally here, more cars and motorcyclists are traveling, and children are playing outside. With so many additional people on or close to our roadways, it is important to remember that distracted driving can result in not only damage to your vehicle, but injury or death to those around you.

In both New Jersey and Pennyslvania, distracted driving resulting in injury or death may lead to a civil lawsuit and criminal charges that expose you to a significant state prison sentence.

In Pennsylvania, a death related to distracted driving is considered Homicide by Vehicle, a third degree felony, which carries a maximum of 7 years in Pennsylvania State Prison and up to a $15,000.00 fine. In New Jersey, Death by Auto is graded as a second degree crime (and in some cases a first degree crime), which carries a maximum of 10 years in New Jersey State Prison and up to a $150,000.00 fine. The penalties for these offenses are severe, but can be easily avoided by using hands-free calling, waiting to answer a text message until your vehicle is stopped and parked, and keeping your eyes on the road.
