One Gun Per Month Law Valid

A New Jersey statute which limits purchases of firearms to one handgun per month has been upheld by a three judge panel of the United States Court of Appeals for the Third Circuit.

It was argued by an affiliate group of the National Rifle Association that the law violated New Jersey resident’s due process rights and that the law also was preempted by federal law, which declares that states cannot prohibit the sale of BB guns and air guns.

The U.S. appeals court denied that due process rights were violated by the law. With regard to the BB and air gun issue, the court stated that New Jersey’s law does not prohibit the sale of BB and air guns; it merely regulates their sale, which is not in conflict with federal law.
