Strong Appellate Advocacy Nets Reversal for Law Firm’s Client

On May 1, 2025, Managing Partner Scott M. Wilhelm, Esq. secured a reversal in the Superior Court of New Jersey, Appellate Division of the Law Division’s entry of a Final Restraining Order against his client. Mr. Wilhelm argued on appeal that, at the restraining order trial, the Law Division Judge improperly found that his client had engaged in harassing conduct and that there was no need for an order of protection. While acknowledging that reversals of trial courts are uncommon, the Appellate Division agreed with Mr. Wilhelm’s argument and found that the interest of justice required a reversal. The Appellate Division remanded the case to the Law Division with a direction to vacate the improperly entered Final Restraining Order. This decision demonstrates that strong appellate advocacy can result in an injustice being corrected.
