Our Firm often receives calls from New Jersey landlords asking us to assist them in evicting their tenant so they can place a rental property on the market. What they do not realize is that there are only a certain number of legal grounds under which you can evict a tenant; sale of the property is not one of them. The reasons for eviction are enumerated in the New Jersey Statutes under N.J.S.A. 2A:18-61.1. If you do not have a legally permissible reason to evict your tenant, the tenancy will be included in the sale of the property. As a landlord it is imperative that you understand your obligations and rights under the law.
