On April 26, 2023, Managing Partner Scott M. Wilhelm persuaded a sentencing court not to incarcerate his 20-year-old client who previously had plead guilty to aggravated assault with a deadly weapon. Mr. Wilhelm’s client and another gentleman engaged in a mutual fight which resulted in his client stabbing the victim in the abdomen with a knife. Mr. Wilhelm was able to demonstrate to the Court that his client’s youth, immaturity, and substance use had contributed to poor decision making and that in the last year since his client was charged that his successful participation in counseling has helped him mature and that his conduct will not recur.

On April 27, 2023, Mr. Wilhelm also persuaded another sentencing court not to incarcerate his 37-year-old client who had plead guilty to the felony offense of risking a catastrophe when he started a fire in his home. Mr. Wilhelm was able to demonstrate that his client’s anger and alcohol abuse were contributing factors, but that in the six months since the offense his client has participated successfully in anger management and substance abuse counseling.
